Typofonderie’s offers are aimed to persons acting in the scope of their professional activity.
Typofonderie welcomes its visitors, who will find hereafter Typofonderie’s Terms & conditions.
These Terms and Conditions exclusively apply to all person visiting and purchasing on typofonderie.com website, edited and operated by Typofonderie whose business address is based at 144 avenue Jean Jaurès, 92140 Clamart, France1.
These Terms & Conditions are expressly accepted without reserve, by the typofonderie.com visitor who admits having a perfect knowledge of these Terms & Conditions, and more particularly when placing any order on this website, in particular special conditions such as the signature of the End User License Agreement when purchasing a digital font license(s). The end user is bound by these General Terms & Conditions and by any Terms & Conditions which do not correspond to these Terms & Conditions cannot be accepted by Typofonderie.
These Terms & Conditions are subject to be modified at any time and without notice, knowing that the conditions applied on typofonderie.com are those of the date of the order. Any other Terms & Conditions produced by typofonderie.com’s visitor will have no legal value and cannot engage the responsibility and/or liability of typofonderie.com, nor of Typofonderie. Access to typofonderie.com’s visitor area and/or user area, whatever the service, visiting typofonderie.com tacitly implies that typofonderie.com’s visitor accepts Typofonderie’s Terms & Conditions.
Any online and offline offer promoted by Typofonderie is reserved for professionals (companies, administrations, professionals, institutions, craftsmen, tradesmen, associations) all over the world.
Typofonderie.com visitors are informed that these Terms & Conditions do not require a handwritten signature to be accepted and that the validation a product order online constitutes and binds the visitor to these Terms & Conditions.
Typofonderie.com is liable to its visitors in respect to the proper performance of any obligations under this agreement, whether such obligations are being performed by itself or by other service providers, without prejudice to its right to take any legal action against such visitors.
HHowever, typofonderie.com may be exempted from all or part of its responsibility by demonstrating that the non-performance or improper performance of the obligations set out in this agreement(s) is attributable either to typofonderie.com’s visitor(s), or to the unforeseeable and unavoidable events or causes, a third party unconnected with the provision of benefits under this agreement, or in the event of « force majeure » or events such as a lockout, strike, work stoppage or partial stoppage in the seller’s or its suppliers’ factory, epidemics, war, requisition, fire, flood, interruption or delay in transport, legal or administrative measures preventing, restricting, delaying or prohibiting the manufacture or importation of the goods, the seller is then released from any liability for delivery. Typofonderie.com keeps its visitors informed in a timely manner, of such cases and events as listed above. In all cases, shipping delays can only occur if the buyer has fulfilled his obligations towards typofonderie.com whatever the cause.
These conditions of sale are established in both French and English languages.
Goods
Typofonderie distribute digital fonts for digital world and tangible goods through its website.
Copyright & licensing
As typographic design, the Typeface generated by the digital font licensed by Typofonderie is protected by the French Intellectual Property Code following but not limited to the Art. L. 111-1, Art. L.112-1, Art. L.112-2, L.122.4 and following, regardless of the country in which you are operating, by the copyright laws and intellectual property code, by other international treaties. By paying, downloading, installing and/or using digital font, you confirm that you have read and accepted the terms of the End user license agreement, which bind you legally to Typofonderie and that you have the legal capacity to contract.
According to any violation, and contrary action to this rule, or if you don’t accept these terms you will not be authorized to use this product/ digital(s) font(s). Neither Typofonderie nor its suppliers are allowed in enabling to carry out actions contrary to those prerogatives.
Typofonderie is a registered trademark of ZeAssociates SARL. All Typofonderie’s trademarks, logo, pictures, texts, fonts posted on typofonderie.com are the sole property of Typofonderie and its third parties partners. Any use of these trademarks will be granted without the prior agreement of Typofonderie.
Unless express written authorization signed by Typofonderie, it is strictly forbidden to reproduce any information or documents from this website whatever the means, the resource or the form used.
Terms of payment
Typofonderie’s visitor can choose between several payment options offered by typofonderie.com: Carte Bleue, e-carte bleue (french customers), VISA, MasterCard, American Express.
Payzen is a secure solution created by Lyra-Network and PCI DSS certified Lyra-Network is a leader in the delivery of French bank flows from payment terminals. In case of credit card payment, typofonderie.com customer’s bank account is debited on the day of the order date and immediate download.
Transaction
Payment by credit card is in conformity with Payzen payment system. In case of such payment by credit card, the client of typofonderie.com’s account is debited the day of the order and immediate download.
Each data registered by typofonderie.com constitutes the evidence of all the commercial transactions carried out between Typofonderie and its clients. Any data registered by the Payzen payment system is provided by Payzen and the Crédit Mutuel, used and chosen by the typofonderie.com customer (bank or any other establishment) and thus constitutes the evidence of all financial transactions carried out between Typofonderie and the establishment in question (or any other organization).
Payment by bank transfer
Available only for offline purchases, bank transfer or wire transfer can be organized under the condition that any currency exchange fees are the sole responsibility of Typofonderie’s client. For further details on the process, please contact Typofonderie.
Payment by check
Check payment is only available for French clients. In such a case, Typofonderie’s clients must send their Check payment by mail and must obligatorily enclose a printed copy of their current Order placed on typofonderie.com and/or the invoice sent to them by Typofonderie.
Online order
Typofonderie.com visitors and/or clients can place their order(s) directly on the typofonderie.com website. Any order from a typofonderie.com client having an unresolved payment dispute with Typofonderie cannot be delivered or his order will be cancelled by typofonderie.com.
Once the typofonderie.com client’s transaction is validated by Typofonderie’s bank, typofonderie.com will send its client a receipt and its access key to download the digital font(s). The client will then be able to access his receipt, order details, invoice and access to download the digital font(s) from his account (My account) on Typofonderie.com.
Offline order
In case a typofonderie.com’s visitor cannot purchase digital font(s) online, he must directly generate its order on typofonderie.com and specify his need by completing all billing and shipping information, including complete end-user information required in case of licence purchase. Any order placed by a typofonderie.com client with an unresolved payment dispute with Typofonderie will not be delivered or the order will be cancelled by Typofonderie.
Once the typofonderie.com client’s transaction is validated by Typofonderie’s bank, typofonderie.com will send its client a receipt and its access key to download the digital font(s). The client will then be able to access his receipt, order details, invoice and access to download the digital font(s) from his account (My account) on Typofonderie.com.
Special orders
If typofonderie.com visitor needs to order Digital Font licenses which are not available on typofonderie.com (like artwork license as an example), or any special license not covered by the standard End User License Agreement, please contact Typofonderie who will send you back a quote.
Prices and VAT
All typofonderie.com prices are displayed in euros and do not include applicable taxes. Any typofonderie.com client residing in France and/or in the DOM territories and/or in a EEC member country will have to pay the additional French tax “VAT” which is calculated when you place your order. The French VAT will be applied from “Amount before tax” of the item ordered according to its category and will be reported on the receipt and the invoice of typofonderie.com’s client.
Any valid VAT number entered by a business client (Euro Zone only) will be checked by typofonderie.com to validate the order. A valid VAT number will result in a total order amount to be paid in Tax Free ( without French VAT), while an invalid VAT number will result a total order including French VAT.
Typofonderie.com clients cannot be charged for any delivery costs related to online download(s) sales, according to the French « guideline » signed on 1997, May 20th: “the client can not be reimbursed for the downloaded products on the Internet”, « digital font » for Typofonderie.
Therefore it only applies to online upload sales. Delivery fees for a shipping are invoiced as announced on typofonderie.com website, when items are shipped using standard shipping methods.
Claim & customer service
Typofonderie is solely responsible for offers, contents and commitments of this present typofonderie.com website. Typofonderie will directly negotiate each complaint or dispute relative to payment or downloaded goods on this present typofonderie.com website. Concerning any other complaint regarding payment transactions, bank or third parties in charge of transaction can be consulted.
Risk transfer
Risks and responsibilities for paid items are transferred to the typofonderie.com client after he/she has downloaded or received his/her order from Typofonderie. Typofonderie cannot be held in any way responsible after the transfer has occurred. The products are only insured on express instruction and at the expense of the customer of typofonderie.com and are delivered to the location indicated by the customer in the order received by Typofonderie.
Upon receipt of the item(s), the customer must check after the download on Typofonderie and/or upon delivery the conformity of the delivered item(s).
For any loss or damage upon receipt, the customer of typofonderie.com must report any opposition to Typofonderie in accordance with Article L133-3 of the French Commercial Code.
Governing Law
In the event of a dispute, the only law having value is French law in front of the Courts of Paris (75 - France).
Privacy
Under orders or when visitors create an account on typofonderie.com, Typofonderie is brought to collect personal data. These data are processed and stored within conditions designed to ensure their safety. Some of these data are essential for processing applications or client orders. Warranty & responsibilities
In order to maintain compliance with these Terms & Conditions, Typofonderie reserves the right to control at any time any information, documents and materials present on typofonderie.com whatever the reason.
However, Typofonderie is not able to review all content posted by visitors on typofonderie.com, such as comments on blog posts. Therefore, Typofonderie cannot be blamed or held liable for any records, information, errors or materials posted by visitors to Typofonderie.com. In order to maintain compliance with French and international laws as well as regulations, Typofonderie reserves the right, at any time, to modify, delete, or not to distribute any content that does not comply with current laws and/or violates Typofonderie.com’s Terms & Conditions.
In addition, materials and services provided by Typofonderie do not and will not be guaranteed in any way by Typofonderie. Under no circumstances does Typofonderie agree nor endorse the accuracy or viability of the Publications of visitors and third parties posted or distributed by typofonderie.com.
